Your use of the Website may also be governed by our:

  • Privacy Policy;
  • Shipping & Return Policy;
  • Corporate Gifting Policy, where applicable;
  • Cancellation and Refund terms; and
  • Any other policy or terms displayed on the Website.

These policies should be read together with these Terms and Conditions.

Alpinecart reserves the right to update, amend, modify, add, or remove portions of these Terms from time to time. Any revised version will become effective upon publication on the Website unless otherwise specified.

Your continued use of the Website following the publication of updated Terms constitutes acceptance of those changes, subject to applicable law.

  1. Eligibility to Use the Website

The Website is intended for individuals who are legally capable of entering into binding contracts under the Indian Contract Act, 1872, and other applicable laws.

By using this Website or placing an order, you represent that:

  • You are at least 18 years of age; or
  • You are accessing the Website under the supervision and with the consent of a parent or legal guardian who is legally competent to enter into a contract.

Individuals who are legally incompetent to enter into contracts, including minors acting independently and undischarged insolvents, may not enter into binding transactions through the Website.

Alpinecart reserves the right to restrict, suspend, or terminate access to the Website where it reasonably believes that a user does not meet the applicable eligibility requirements or has violated these Terms.

  1. User Accounts and Registration

Certain Website features may require you to create an account. When creating or using an account, you agree to provide accurate, complete, current, and truthful information.

You are responsible for:

  • Maintaining the confidentiality of your username, password, and account credentials;
  • Restricting unauthorized access to your device and account;
  • Ensuring that your account information remains accurate and up to date; and
  • All activities conducted through your account, except where unauthorized use occurs through no fault of your own.

You should promptly notify Alpinecart if you become aware of any unauthorized access to or use of your account.

Alpinecart reserves the right to suspend, restrict, or terminate an account where information provided is materially inaccurate, false, misleading, incomplete, or where the account is used in violation of these Terms or applicable law.

  1. Orders and Order Acceptance

Placing an order through the Website constitutes an offer by the customer to purchase the selected products subject to these Terms.

An order is not necessarily considered finally accepted merely because:

  • It has been submitted through the Website;
  • Payment has been authorized or processed; or
  • An automated acknowledgment has been generated.

An order shall be considered accepted when Alpinecart confirms its acceptance or dispatches the product, depending on the circumstances of the transaction.

Alpinecart reserves the right, subject to applicable law, to accept, reject, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability;
  • Pricing or description errors;
  • Payment failure or suspected payment irregularities;
  • Incomplete or incorrect delivery information;
  • Suspected fraud or unauthorized transactions;
  • Delivery restrictions;
  • Technical errors;
  • Bulk purchasing or suspected unauthorized resale;
  • Violation of these Terms; or
  • Other reasonable operational or legal grounds.

Where an order is cancelled by Alpinecart after successful payment, any eligible refund will be processed in accordance with the applicable refund policy and payment method.

  1. Product Availability

All products displayed on the Website are subject to availability.

The availability of live plants and other natural products may vary due to seasonal conditions, weather, sourcing limitations, plant health, agricultural factors, or other circumstances beyond Alpinecart's reasonable control.

Alpinecart does not guarantee that every product displayed on the Website will remain continuously available.

If a product becomes unavailable after an order is placed, Alpinecart may contact the customer and, where appropriate:

  • Offer a suitable alternative;
  • Modify the order with the customer's consent;
  • Delay fulfilment with the customer's agreement; or
  • Cancel the affected product or order and process an applicable refund.
  1. Product Descriptions and Natural Variations

Alpinecart makes reasonable efforts to provide accurate product descriptions, images, specifications, dimensions, colours, care information, and other product-related content.

However, actual products may differ slightly from photographs or illustrations displayed on the Website due to factors such as:

  • Screen and display settings;
  • Lighting and photography;
  • Manufacturing variations;
  • Handcrafted characteristics;
  • Seasonal changes; and
  • Natural differences in living plants.

Plants are living products and may naturally vary in size, shape, height, colour, foliage density, number of leaves, flowering stage, growth pattern, or overall appearance. Such reasonable natural variations do not necessarily constitute defects.

If a product is materially different from its description or is received damaged or defective, customers should contact Alpinecart in accordance with the applicable Shipping & Return Policy.

  1. Pricing and Typographical Errors

Alpinecart aims to ensure that all product prices, discounts, descriptions, and other information displayed on the Website are accurate. However, occasional typographical, technical, pricing, or catalogue errors may occur.

If an incorrect price or material product information is displayed, Alpinecart reserves the right to correct the error and, where appropriate:

  • Inform the customer of the corrected information;
  • Request confirmation to proceed with the order at the corrected price; or
  • Cancel the affected order and process an applicable refund where payment has already been received.

Prices may change without prior notice. However, changes will generally not affect orders already accepted by Alpinecart unless an obvious pricing or technical error has occurred, subject to applicable law.

Unless otherwise stated, prices will be displayed in Indian Rupees (₹).

  1. Taxes and Charges

Product prices may include or exclude applicable taxes, delivery charges, handling fees, or other charges depending on how such information is displayed during checkout.

The final payable amount will ordinarily be shown to the customer before completion of the order.

The customer is responsible for reviewing the final order summary, including the products, quantities, prices, applicable taxes, shipping fees, discounts, and delivery information, before completing the transaction.

  1. Payments

Alpinecart may accept payments through available payment methods displayed during checkout, which may include:

  • Credit cards;
  • Debit cards;
  • UPI;
  • Net banking;
  • Digital wallets;
  • Cash on Delivery, where available; or
  • Other approved payment methods.

Availability of a particular payment method may depend on the customer's location, order value, product category, delivery serviceability, and other operational considerations.

Alpinecart may decline, cancel, or place an order on hold where payment is unsuccessful, unauthorized, disputed, or suspected to be fraudulent.

Customers are responsible for providing accurate billing and payment information.

  1. Shipping and Delivery

Orders are generally dispatched from our warehouse within 2 working days of order confirmation, subject to product availability and operational circumstances.

Most orders are expected to be delivered within 2–6 working days from the date of order placement, depending on:

  • Delivery location;
  • Courier serviceability;
  • Product availability;
  • Weather conditions;
  • Public holidays;
  • Natural disasters;
  • Transportation disruptions; and
  • Other circumstances beyond Alpinecart's reasonable control.

Delivery timelines are estimates and should not be interpreted as guaranteed delivery dates unless expressly agreed in writing.

Alpinecart works with third-party courier and logistics providers and shall not be responsible for delays exclusively caused by such third parties or circumstances outside its reasonable control, except to the extent required by applicable law.

Shipping charges and free-shipping eligibility will be determined according to the applicable shipping policy displayed on the Website. At present, free shipping may be available on eligible orders above ₹499, subject to applicable terms and exclusions.

  1. Delivery Information and Failed Deliveries

Customers are responsible for providing complete and accurate delivery information, including:

  • Recipient's full name;
  • Complete delivery address;
  • Correct PIN code;
  • Valid telephone number; and
  • Any necessary delivery instructions.

Alpinecart will not be responsible for failed, delayed, or incorrect deliveries caused by inaccurate, incomplete, or outdated information provided by the customer.

If a shipment is returned due to:

  • Incorrect delivery details;
  • Recipient unavailability;
  • Repeated failed delivery attempts;
  • Customer refusal without a valid reason; or
  • Any other customer-related circumstance,

additional shipping or redelivery charges may apply.

  1. Risk of Loss and Damage

Alpinecart takes reasonable care in selecting, inspecting, packaging, and dispatching products.

If a product arrives damaged, defective, incorrect, or materially affected during transit, the customer should report the issue within the timeframe and according to the procedure specified in the applicable Shipping & Return Policy.

Customers may be required to provide:

  • Clear photographs of the product;
  • Photographs of the outer and inner packaging;
  • Videos, where reasonably requested;
  • Shipping labels;
  • Order details; and
  • Other relevant evidence necessary to verify the claim.

Risk and responsibility will be determined in accordance with applicable law, the circumstances of the transaction, and the relevant Alpinecart policies.

  1. Returns, Replacements and Refunds

Returns, replacements, refunds, and other resolutions are governed by Alpinecart's applicable Shipping & Return Policy.

Plants and Living Products

Due to their living and perishable nature, plants are generally not eligible for standard returns. Repeated transportation can cause significant stress and deterioration to living plants.

Minor differences in size, shape, foliage, colour, or appearance, as well as temporary transit stress, do not necessarily constitute product defects.

Customers concerned about the health or condition of a plant upon delivery should contact Alpinecart promptly and provide appropriate photographic or video evidence for assessment.

Non-Plant Products

Eligible non-plant products may be returned within the applicable return period specified in the Shipping & Return Policy, provided that all relevant conditions are met.

Unless otherwise specified, eligible non-plant products may be returned within 7 days from the date of delivery.

For preference-based or change-of-mind returns, the customer may be responsible for return shipping charges.

Refunds or replacements will be processed only after the applicable eligibility requirements and verification procedures have been completed.

  1. Corporate Gifting Orders

Corporate, bulk, customized, personalized, and business gifting orders may be governed by a separate Corporate Gifting Policy.

Where applicable, corporate gifting orders may have different terms concerning:

  • Order confirmation;
  • Payment;
  • Cancellation;
  • Customization;
  • Procurement;
  • Refunds;
  • Replacements;
  • Issue reporting; and
  • Resolution timelines.

In the event of a conflict involving a corporate gifting order, the specific Corporate Gifting Policy and written terms expressly agreed for that particular order will apply, subject to applicable law.

  1. Cancellation of Orders

Customers may request cancellation in accordance with the applicable cancellation policy.

For standard retail orders, cancellation eligibility may depend on the order status and whether processing, procurement, customization, packaging, or dispatch has commenced.

Corporate gifting orders are subject to the specific cancellation provisions contained in the Corporate Gifting Policy.

Alpinecart reserves the right to cancel orders for legitimate operational, technical, payment-related, legal, fraud-prevention, or product-availability reasons.

Any applicable refund following cancellation will be processed in accordance with the relevant refund policy.

  1. Seeds, Nutrients and Regulated Products

By purchasing seeds, nutrients, fertilizers, plant-care products, or other regulated products from Alpinecart, the customer agrees to use such products responsibly, lawfully, and only for their intended purposes.

Customers must comply with all applicable laws, regulations, instructions, warnings, and product-use requirements.

Products must not be used, resold, transferred, or otherwise dealt with for any unlawful or prohibited purpose.

Alpinecart shall not be responsible for loss or damage resulting from misuse, improper storage, unauthorized application, or use contrary to product instructions, except where liability cannot legally be excluded.

  1. Permitted Use of the Website

  • Facilitates spam, unsolicited commercial communications, or fraudulent activity; or
  • Otherwise disrupts the security, operation, integrity, or functionality of the Website.

Alpinecart may restrict or terminate access where it reasonably determines that these Terms have been violated.

Nothing in these Terms prevents customers from making genuine reviews, lawful complaints, truthful statements, or exercising rights available under applicable law.

  1. Customer Reviews and User-Submitted Content

Where the Website permits users to submit reviews, comments, photographs, videos, feedback, or other content, users remain responsible for the material they submit.

  • The content is truthful to the best of your knowledge;
  • It does not unlawfully infringe another person's intellectual property, privacy, or other rights; and
  • It does not contain illegal, fraudulent, threatening, obscene, defamatory, or malicious material.

Alpinecart reserves the right to moderate or remove content that violates these Terms or applicable law.

Limited personal and non-commercial use of the Website does not transfer any ownership or intellectual property rights to the user.

  1. Third-Party Websites and Services

The Website may contain links to third-party websites, platforms, payment gateways, courier services, or other external services.

Such third-party services operate independently and may be governed by their own terms, policies, and privacy practices.

Unless expressly stated otherwise, Alpinecart does not control, endorse, or assume responsibility for:

  • Third-party website content;
  • External services;
  • Third-party products;
  • Privacy practices of external websites; or
  • Loss arising exclusively from the independent actions of third parties.

Users should review the applicable terms and policies before using third-party services.

  1. Limitation of Liability

To the maximum extent permitted by applicable law, Alpinecart shall not be liable for indirect, incidental, special, or consequential losses arising from circumstances beyond its reasonable control or from misuse of products or the Website.

Without limiting the above, Alpinecart shall not ordinarily be responsible for loss resulting from:

  • Customer-provided incorrect information;
  • Improper product use, storage, handling, or care;
  • Natural variations in plants or other living products;
  • Unauthorized access caused by a customer's failure to protect account credentials;
  • Third-party service interruptions;
  • Courier delays beyond Alpinecart's reasonable control; or
  • Force majeure events.

Nothing in these Terms excludes, limits, or restricts liability or consumer rights that cannot legally be excluded, limited, or restricted under applicable law.

  1. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Alpinecart and its officers, directors, employees, affiliates, authorized representatives, and agents from claims, liabilities, damages, losses, and reasonable costs arising directly from:
